Terms & Conditions for the Harley-Davidson “The Great Relay 22 Competition” (the “Competition”)
Introduction
The Competition is organised and run by Harley-Davidson Benelux Limited (“H-D”), who can be contacted at 33 Avenue van Vredenoord 2289DA Rijswijk, the Netherlands.
By entering this Competition, you agree to these Terms and Conditions (the “Terms”) and any decisions reached by H-D, which are final and binding in all matters related to this Competition.
The Competition starts at 09:00 (GMT) on 1February 2022 and ends at 23:59(GMT) on 28 February 2022 (the “Competition Period”).
Who can enter this Competition?
Participants must:
be residents of, and have a postal address in Belgium, the Netherlands, Luxembourg, Denmark, Finland, Sweden or Norway;
have a valid H.O.G. membership;
be aged 24 or over; and
have a valid motorcycle licence “A” for heavy motorcycles over 35kW.
The Competition is not open to directors, members, partners, employees, agents or consultants of H-D, any person who directly or indirectly controls or is controlled by H-D, or any supplier of goods or services in connection with the Competition, or their spouses, life partners, business partners or immediate family members.
By entering the Competition, you hereby warrant that all information submitted by you is true, current and complete. H-D reserves the right to verify the eligibility of all participants and disqualify a participant for submitting false information.
How does the Competition work?
No purchase is necessary to enter the Competition and entry is free.
a video application (in English) during the Competition Period explaining the following: (a) why they are the perfect person to win the Competition, (b) what they are most looking forward to if they win the Prize (defined below), (c) which places they will definitely visit if they win the Prize, (d) their rough planned route should they win the Prize, (e) how they would share their journey with fellow H.O.G. members should they win the Prize, and (f) the participant’s communication skills and experiences; and
the participant’s name, age, telephone number, email address, H.O.G. membership number, country of residence and a scan/image of their motorcycle licence;(together, an “Entry”).
Each participant can only enter the Competition once. If a submission fails to satisfy any or all requirements of an Entry, it will not be counted as a valid Entry and will be void.
All Entries must be received by H-D during the Competition Period, or they will be void. H-D will not accept responsibility for:
Competition Entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
any change in dates, times or cancellations or other arrangements that may prevent a winner from accepting, taking or using the Prize.
On 17 March 2022, one (1) winner will be selected by a jury of three (3) members of H-D staff and one (1) independent external party, from all valid Entries received. The winning Entry will be chosen based on how creative it is and the participant’s communication skills.
H-D will send the full names of the judges to anyone who writes to H-D requesting these details (and who encloses a self-addressed envelope) at the address set out in clause 1(a) within one (1) month of the end of the Competition Period.
The winner will be notified on 17 March 2022 via email to the email address they used to submit their Entry to the Competition (“Notification”).
The Prize must be claimed in accordance with the instructions in the Notification message, within seven (7) days of the Notification (the “Claim Period”) by emailing H-D at the email address specified in the Notification. In order to receive their Prize, the winners will also need to provide H-D with any further information requested by H-D, in accordance with the instructions set out in the Notification within the Claim Period. Failure to claim the Prize in accordance with the instructions in the Notification within the Claim Period will result in the forfeit of the Prize and an alternative winner will be chosen.
The winner will receive the Prize within the timeframe agreed separately between H-D and the winner after the winner provides H-D with the information requested in the Notification (as set out in clause 3(h)). The Prize journey is to be completed during May-June 2022.
The winner may be required to provide H-D with proof of identification in order to verify compliance with the eligibility requirements for the Competition.
If a winner is found to be ineligible or fails to comply with the Terms, then the winner may, in H-D’s sole discretion, be disqualified and an alternate winner will be selected.
What is the Prize?
There will be one (1) winner.
The winner will receive:
a trip on a Harley-Davidson Pan America motorcycle (the “Trip”), travelling through Belgium, the Netherlands, Luxembourg, Denmark, Finland, Sweden and Norway and visiting the H.O.G. community in these countries. H-D will provide the winner with a suggested Great Relay route (15,000km in length) but this is not mandatory to follow. The Pan America motorcycle shall be waiting for the winner at Cap’s Harley-Davidson Copenhagen in Denmark: Vestre Hedevej 24, DK-4000 Roskilde;
a travel budget of EUR 5,000 to be used only to pay for expenses during the Trip (e.g. hotels, fuel and ferries) (the “Travel Budget”). The Travel Budget is to be transferred to the winner via bank transfer one month prior to the Trip start date;
a GoPro and Garmin to be used to document the Trip; (the “Prize”).
The dates and times for the Prize are subject to availability and shall be agreed mutually between H-D and the winner, but the Trip is to be finished at the Great Rally in Belgium on 18 June 2022. The maximum Trip length is six (6) weeks. During the Trip, the winner must visit a minimum of twenty (20) H.O.G. chapters during the Trip and document the different chapters by blogging, photographing and filming the Trip.
The winner will be required to share their experience of the Trip on the following social media channels: TheGreatRelay22, H-D and H.O.G. EMEA.
The Prize is non-transferable, non-exchangeable, and has a cash value of zero. The Prize is for personal use only and are not for resale. The Prize may be forfeited in the event that H-D determines that the Prize is being misused. H-D reserves the right to substitute a prize of an equal or greater value in its absolute discretion. In the event that circumstances make the Prize unavailable within the timescale set out in clause 4(c), H-D will work with the winner to reschedule the Prize at a mutually convenient time.
Intellectual Property Rights and Use of Submissions
By submitting an Entry to the Competition, participants agree that any such videos are their original creation and will not infringe the intellectual property rights or other rights of any third party.
Participants will retain ownership of the copyright in their Entries to the Competition.
By submitting an Entry to the Competition, the participant grants H-D the worldwide right to use the Entry in relation to the Competition, in advertising and/or marketing of H-D’s products and brand. Such use may include, without limitation, reproducing, copying, translating, adapting, publishing or making available the Entry on H-D’s websites, on any social media account controlled by H-D (or approved third party partners/affiliates), and in H-D’s other advertising and/or marketing materials. The rights granted in this clause are perpetual (i.e. they last forever), and royalty-free (i.e. the participant will not be entitled to any compensation or other payments from H-D).
All participants irrevocably waive all moral rights in their Entries to which they are entitled.
General
The winner may be asked to take part in reasonable publicity in connection with the Competition (in addition to documenting the Trip), including the publishing of their name and geographical location.
H-D reserves the right to amend the rules of the Competition, to withdraw the Competition at any time if circumstances beyond its control make this unavoidable, or to cancel the Prize in the event of non-compliance with these Terms.
H-D will use your personal details to contact you for administrative purposes relating to this Competition.
The winner’s surname and province will be made available. The winner will have the right to object to this information being published or to request a reduction in the amount of information being published. H-D may be required to provide this information to the relevant regulatory authorities.
The decision of H-D regarding any aspect of the Competition is final and binding and no correspondence will be entered into about it.
Any cancellation or changes will be posted on the Competition page ([ENTER PAGE]).
With the exception of liability which cannot be excluded by law, H-D is not liable for, and you release H-D from, liabilities relating to any direct or indirect loss or damage which is suffered, as a result of entering the Competition, failing to win, winning, accepting or using a Prize.
These terms and conditions shall be governed by Dutch law, and the parties submit to the exclusive jurisdiction of the courts of the Netherlands.
